
Terms and Conditions
These Terms and Conditions of Sale (hereinafter referred to as the “Terms and Conditions”) exclusively govern sales made via the website www.salomerico.com (hereinafter the “Site”) for products offered by Salomé Rico (hereinafter “Salomé Rico”) to purchasers (hereinafter the “Client(s)”), and specify in particular the terms of ordering, payment, delivery, and handling of any product returns by Clients.
The vendor’s details are as follows: SLDR operating under the brand name Salomé Rico, SAS with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 892 074 279, with its registered office at 23 rue des Chantereines, 93100 Montreuil, France — contact@salomerico.com, +33 6 15 80 02 29.
Orders placed via the Salomé Rico website are strictly reserved for individual consumers.
The Terms and Conditions are made available to Clients on the Site where they can be directly consulted.
The Terms and Conditions are binding upon the Client, who acknowledges having read and accepted them by checking the box “I accept the Terms and Conditions of Sale” prior to confirming an online order.
Any order placed on the Site constitutes the formation of a distance contract between the Client and Salomé Rico and necessarily implies the Client’s irrevocable, unreserved acceptance of the Terms and Conditions in force at the time of order confirmation.
Salomé Rico reserves the right to amend its Terms and Conditions at any time. In the event of modification, the new Terms and Conditions will apply exclusively to sales made after their publication. The invalidity of any contractual clause shall not render the entire Terms and Conditions void. The temporary or permanent non-application of one or several clauses by Salomé Rico shall not be deemed a waiver of the other provisions, which shall remain fully enforceable.
Products
The products governed by these Terms and Conditions are those listed on www.salomerico.com and indicated as sold and shipped by Salomé Rico. Products are offered within the limits of available stock.
Salomé Rico takes the utmost care in providing accurate information about the essential characteristics of its products, including detailed descriptions and photographs.
However, should errors or omissions occur in this presentation, Salomé Rico cannot be held liable. Product photographs are non-contractual, and the Site reserves the right to remove products from sale at any time.
Orders
To validate an order, the Client must follow the steps indicated by Salomé Rico on the Site. Confirmation of an order implies acceptance of all provisions, forming a binding contract.
Clients are encouraged to carefully check their order details (product, price, quantity) listed in the order summary before confirming their purchase and again upon receiving the order confirmation email.
The Client selects a delivery address, payment method, and confirms the purchase by clicking the relevant button. The Client accepts the Terms and Conditions before proceeding to payment.
The order becomes final when payment is accepted and the Client receives a confirmation email.
Products are made to order; a production time may therefore apply.
Salomé Rico reserves the right to refuse, cancel, or terminate any order at any time for legitimate reasons, such as an ongoing dispute regarding payment or suspected fraud.
Pricing
Product prices are indicated in euros, inclusive of all taxes, excluding delivery fees. The total price payable, including taxes and delivery charges, is shown in the Client’s cart before finalizing the purchase. VAT is included and may vary according to the country of billing.
Since orders are dispatched from France, no customs duties apply for deliveries within the European Union. For orders outside the EU, any applicable customs fees or taxes are the responsibility of the Client.
Salomé Rico reserves the right to adjust its prices at any time without notice. However, the price billed to the Client will always be that shown at the time of order confirmation.
Full payment must be made at the time of ordering; amounts paid cannot be considered as deposits or installments.
Accuracy of Information and Product Descriptions
While Salomé Rico strives to ensure the accuracy of the information published on the Site, in advertisements, and in catalogs, no guarantee is made regarding the accuracy, reliability, or completeness of such information.
Product descriptions and photographs aim to be as accurate as possible, but Salomé Rico does not guarantee the absence of errors, omissions, or outdated elements.
Payment
Payment is due in full at the time of order. Salomé Rico accepts the following payment methods: credit card (CB, Visa, Mastercard), and Apple Pay.
Salomé Rico reserves the right to suspend or cancel any order in the event of payment authorization refusal or non-payment. Salomé Rico may also refuse an order from a Client with unresolved payment disputes or if an order appears fraudulent or unjustified.
Online provision of credit card details and final order validation constitute proof of the transaction and binding agreement under French law.
Salomé Rico reserves the right to reject any suspicious transaction or order, particularly those involving unusually high product quantities.
Security
Client data is used solely within the context of the commercial relationship with Salomé Rico. This data is neither shared with third parties nor sold.
Payment data is transmitted via a secure connection, and Salomé Rico uses systems that ensure transaction security.
While every effort is made to safeguard Client information, Salomé Rico cannot guarantee the integrity or security of data transmitted over the Internet and accepts no liability for any loss or damage resulting from its use.
In the context of fraud prevention, order-related information may be shared with legally authorized third parties for identity and payment method verification.
Proof of Transaction
The records kept in Salomé Rico’s computer systems under reasonably secure conditions shall be considered as proof of communications, orders, and payments between the parties. The archiving of purchase orders and invoices is carried out on a reliable and durable medium, which can be produced as evidence.
Delivery
Products are delivered by La Poste, DHL, or UPS depending on the delivery area, to the address indicated by the Client at the time of the order on www.salomerico.com. The delivery address considered is the one indicated by the Client at the time of the order. Any change to this delivery address by the Client may result in a longer delivery period.
Any parcel returned to Salomé Rico due to an incorrect or incomplete delivery address will be reshipped at the Client’s expense.
Delivery times start from the dispatch of the order confirmation email and are indicative.
In any case, Salomé Rico undertakes to deliver the product within 30 days from the email confirming the product’s fabrication, unless prevented by a force majeure event beyond Salomé Rico’s control or in the event of fault by the Client.
If delivery is delayed by more than 15 days, the Client may request Salomé Rico to proceed with delivery within a reasonable additional period, by sending a registered letter with acknowledgment of receipt.
If delivery is not made within this new reasonable period — and in any case within 30 days — the Client may cancel the order by sending a registered letter with acknowledgment of receipt to Salomé Rico, unless delivery is made in the meantime.
Salomé Rico will proceed with the refund no later than 14 days following the cancellation of the order, using the same payment method initially used by the Client.
Product Reception
Salomé Rico invites Clients to refuse any damaged package and to notify customer service, in writing and in detail, of any reservations within 3 days, keeping written proof. Otherwise, Salomé Rico will consider the products received by the Client to be satisfactory.
Right of Withdrawal
In accordance with applicable legal provisions, the Client has a period of 14 days from receipt of the product to exercise the right of withdrawal without needing to justify reasons or pay penalties, for a refund.
The Client informs Salomé Rico of their decision to withdraw by sending a written request (letter, email) clearly stating the order number to contact@salomerico.com. The Client may also send the withdrawal form provided in the Annex of these T&Cs by post.
Salomé Rico will acknowledge receipt of this request via email.
The Client commits to returning the product within 14 days following communication of their withdrawal decision. Products must be returned in their original packaging, complete (product, possible accessories, tags attached, instructions) and in perfect condition.
The right of withdrawal only applies to products not used or altered by the Client. Returns must be in perfect, resalable condition.
Damaged, soiled, incomplete, or late returns will not be accepted. All returns are subject to a quality control check by Salomé Rico to ensure compliance with return conditions. If accepted, Salomé Rico will refund the Client.
Return shipping costs are borne by the Client, deducted from the refund, via a return label sent by Salomé Rico upon request. Salomé Rico disclaims responsibility for any loss, theft, or damage during return transport.
Refunds will be made using the same payment method initially used by the Client.
Personalized products (materials, stones, engravings, size, design, packaging, etc.) are not eligible for return or refund.
Timeframe Computation
In accordance with Article L221-19 of the French Consumer Code and EU Regulation No. 1182/71:
1° The day the contract is concluded is not included in the 14-day withdrawal period.
2° The period begins at the start of the first hour of the first day and ends at the expiry of the last hour of the final day.
3° If the period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.
Warranties
Salomé Rico’s warranty does not cover defects resulting from abnormal use, mishandling, or causes unrelated to the intrinsic qualities of the products.
Products benefit from the legal warranty of conformity (Article L. 211-4 of the French Consumer Code) and warranty against hidden defects (Articles 1641 et seq. of the French Civil Code), independently of the right of withdrawal.
Legal Warranty of Conformity
The seller must deliver a product that conforms to the contract and is liable for any non-conformities existing at the time of delivery.
To comply, the product must:

Be suitable for the purpose usually expected from similar goods.

Match the description provided by the seller and possess the qualities presented to the Client as a sample or model.

Possess the qualities reasonably expected by the Client in view of public statements made by the seller, including in advertising or labeling. Or:

Have the features agreed upon by both parties, or be suitable for any special purpose made known to the seller and accepted by them.
In case of non-conformity, the Client has 2 years from delivery to take action.
The Client must notify Salomé Rico in writing at 2 rue Huysmans, 75006 Paris or via contact@salomerico.com, specifying:

Order number, name, address.

Reference(s) of the product(s).

Reason for the return.

Preferred solution: repair, replacement, or refund.
Returned products must be new and in their original packaging.
The Client chooses between repair or replacement.
If neither is possible within one month, or if a refund is the only reasonable option, the Client may: i) Return the product for a full refund, or
ii) Keep the product for a partial refund.
Warranty Against Hidden Defects
Within 2 years from the discovery of a defect rendering the product unsuitable for use, the Client may request a full or partial refund, as per Articles 1641 to 1648 of the French Civil Code, under the same conditions as the legal warranty of conformity.
Transfer of Ownership and Risk
Ownership transfers to the Client upon full payment, regardless of delivery date.
The risk of loss or damage transfers to the Client upon physical possession of the product.

Intellectual Property
Clients acknowledge that all site content, products, and distinctive signs (illustrations, texts, labels, trademarks, images, photos, packaging, product names, etc.) are the exclusive property of Salomé Rico.
Any reproduction, in whole or in part, by any means and on any medium, is subject to prior express authorization.
The Client shall refrain from any reproduction, exploitation, or appropriation of these elements, whether protected or not by patent, trademark, design, or copyright. Any unauthorized use constitutes counterfeiting, punishable by French law.
Liability
Each party is responsible for the consequences of their own faults, errors, or omissions.
Salomé Rico shall not be held liable for contractual non-performance due to the Client, an unforeseeable and insurmountable event by a third party, or a force majeure event.
Dispute Resolution and Applicable Law
Sales via the Site are governed by French law.
In case of a dispute, the parties will attempt conciliation.
Failing this, any disputes will be subject to the exclusive jurisdiction of the courts within the jurisdiction of the Paris Court of Appeal.
Personal Data
Salomé Rico is responsible for processing Client data.
Data is processed to manage orders, requests, and marketing.
Personal data is retained only as long as necessary for its purpose.
In accordance with the French Data Protection Act of January 6, 1978, and EU Regulation 2016/679, Clients have rights to access, rectify, and delete their personal data at any time via the site’s contact form or by email at contact@salomerico.com.
Clients are invited to consult Salomé Rico’s Privacy Policy at www.salomerico.com.
Force Majeure
Any circumstances beyond the parties’ control preventing normal contract execution shall suspend obligations.
The party invoking force majeure must promptly notify the other party.
Expressly considered as force majeure are events typically recognized by French courts, including transport blockages, earthquakes, fires, floods, lightning, pandemics, telecommunications outages, and supplier issues.
If such circumstances persist for over three months, the T&Cs may be terminated by the injured party.
Special Orders
Special orders (semi-custom, custom, made-to-measure) are neither exchangeable nor refundable. The contract is formed upon receipt of the signed, dated quotation and full payment.
